Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the website www.dawnfenland.sbs (the "Service") operated by Dawn Fenland ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Booking and Payment

2.1 Making a Booking

By making a booking with us, you confirm that you have the authority to accept these Terms on behalf of yourself and all members of your party. The lead booker is responsible for making all payments due to us.

Once we have received your booking and all appropriate payments, we will, subject to availability, confirm your arrangements by issuing a confirmation invoice. A binding contract between us comes into existence when we dispatch this invoice to you.

2.2 Payment Terms

To confirm your booking, you must pay a deposit as specified at the time of booking. The balance of the price must be paid no later than 90 days before your departure date. If the booking is made within 90 days of the departure date, the full cost of the booking must be paid at the time of booking.

If we do not receive all payments due in full and on time, we reserve the right to treat your booking as cancelled by you, in which case the cancellation charges set out in Section 4 will become payable.

2.3 Accuracy of Information

It is your responsibility to check the confirmation invoice carefully and to let us know immediately of any errors or omissions. The name on your travel documents must match the name on your passport or other government-issued identification that you will use for travel.

3. Prices and Surcharges

3.1 Price Guarantees

The price of your travel arrangements was calculated using exchange rates, transportation costs, and other fees in effect at the time of publication. We reserve the right to change the price of your travel arrangements after you have booked in the event of cost changes due to:

However, there will be no change within 30 days of your departure date.

3.2 Price Surcharges

If the cost of your travel arrangements increases by more than 8% due to the changes mentioned above, you will have the option of:

Should the price of your holiday decrease due to the changes mentioned above, then any refund due will be paid to you, minus our administrative expenses.

4. Cancellation and Changes

4.1 Cancellation by You

If you or any member of your party need to cancel your confirmed booking, the lead booker must notify us in writing. The cancellation takes effect from the date we receive the written notification.

Since we incur costs in cancelling your travel arrangements, you will have to pay the applicable cancellation charges shown below:

Note: Certain travel arrangements (e.g., flight tickets) may not be refundable once confirmed, and any changes or cancellations may incur a 100% cancellation charge regardless of when the change or cancellation is made.

4.2 Changes by You

If you wish to change any part of your confirmed booking, you must inform us in writing as soon as possible. While we will try to assist, we cannot guarantee that changes can be made. Where changes can be made, an administration fee of £50 per person per change will apply, plus any additional costs incurred by us and any costs or charges imposed by any of our suppliers.

4.3 Transferring Your Booking

If you are unable to travel, you may transfer your booking to another person, provided that:

We reserve the right to cancel your booking. We will not cancel less than 30 days before your departure date, except for reasons of Force Majeure, failure by you to pay the final balance, or if the minimum number of participants required for a particular travel arrangement is not reached.

It is occasionally necessary to make changes to your confirmed travel arrangements, and we reserve the right to do so at any time. Most changes will be minor, and we will advise you at the earliest possible date.

5. Our Liability to You

We will accept responsibility for the arrangements we agree to provide or arrange for you as an "organizer" under the Package Travel and Linked Travel Arrangements Regulations 2018, as set out below and as such, we are responsible for the proper provision of all travel services included in your package, as set out in your confirmation invoice.

Subject to these Terms and Conditions, if we or our suppliers negligently perform or arrange those services, and we don't remedy or resolve your complaint within a reasonable period, we will pay you reasonable compensation. The level of such compensation will be calculated taking into consideration all relevant factors such as but not limited to: following the complaints procedure as described in these Terms and the extent to which ours or our employees' or suppliers' negligence affected the overall enjoyment of your holiday.

We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost, or other claim of any description if it results from:

6. Your Responsibilities

6.1 Travel Documents

You are responsible for ensuring that you and all members of your party have valid travel documents, including:

We cannot accept responsibility if you are refused entry onto any transport or into any country due to failure on your part to carry correct documentation.

6.2 Behavior

All our customers are expected to conduct themselves in an orderly and acceptable manner and not to disrupt the enjoyment of others. If in our opinion or in the opinion of any hotel manager, tour leader, or other person in authority, your behavior or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any other customers or any third party, or damage to property, or to cause a delay or diversion to transportation, we reserve the right to terminate your booking with us immediately.

In the event of such termination, our liability to you and/or your party will cease and you and/or your party will be required to leave your accommodation or other arrangements immediately. We will have no further obligations to you and/or your party. No refunds for lost accommodation or any other arrangements will be made and we will not pay any expenses or costs incurred as a result of termination.

6.3 Travel Insurance

It is a condition of your contract with us that you have adequate travel insurance in place. You must be satisfied that your insurance fully covers all your personal requirements including pre-existing medical conditions, cancellation charges, medical expenses, and repatriation in the event of accident or illness.

7. Complaints

If you have a problem during your holiday, please inform the relevant supplier (e.g., your hotelier) and our local representative immediately, who will endeavor to put things right. If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to our Customer Services Department at the address provided on our website, giving your booking reference and all other relevant information. It is strongly recommended that you communicate any complaint to the supplier of the services as well as to our representative without delay.

If you fail to follow this procedure, we will have been deprived of the opportunity to investigate and rectify your complaint and this may affect your rights under this contract.

8. Force Majeure

Except where otherwise expressly stated in these Terms, we will not be liable or pay you compensation if our contractual obligations to you are affected by "Force Majeure". In these Terms, Force Majeure means any event beyond our or our supplier's control, the consequences of which could not have been avoided even if all reasonable measures had been taken.

Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labor strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our or the supplier(s) concerned's control.

9. Data Protection

We will use and process your personal data in accordance with our Privacy Policy, which is available on our website. By booking with us, you consent to the collection, processing, and sharing of your personal data in accordance with our Privacy Policy.

10. Law and Jurisdiction

These Terms are governed by the laws of England and Wales. We both agree that any dispute, claim, or other matter which arises between us out of or in connection with your contract or booking will be dealt with by the Courts of England and Wales only.

11. Changes to Terms

We reserve the right to change these Terms at any time. Any changes will be posted on our website. Your continued use of our website and services after any such changes constitutes your acceptance of the new Terms.
